Bankruptcy and COVID-19

The COVID-19 crisis has dramatically changed business practices across the country. Despite the upheaval, bankruptcy courts are still fully operational and Theresa A. Peterson Law Office is prepared to assist you. Bankruptcy is an available, necessary, lawful remedy for those struggling with debt and we are committed to helping you navigate the process.

The Courts

Minnesota’s bankruptcy courts are located in the Federal Courthouses in Minneapolis, St. Paul, and Duluth. In order to decrease COVID exposure for debtors and their attorneys, the bankruptcy courts have made the following accommodations:

  • Courthouses are closed for most purposes, but the courts are fully staffed and inquiries are handed by phone, email or mail.

  • Hearings, bankruptcy meetings and other court appearances are held by telephone.

  • Digital or alternative signatures are now accepted.

Normally, a bankruptcy case requires one in-person court appearance: the 341 Meeting of Creditors. At the 341 Meeting, the trustee who has reviewed your case will ask a series of general questions, and some questions specific to unique issues in your case.

Before COVID-19, all debtors and attorneys were required to appear in-person at the Federal Courthouse for the 341 Meetings. Now, the same meetings will be held by telephone for all cases filed through October 10, 2020. We expect the courts to continue the telephone meetings even beyond that date.
